    (the “Contest”)

    OFFICIAL CONTEST RULES & REGULATIONS (“Official Rules”)

    No purchase necessary to enter or win. A purchase will not increase your chances of winning.

    By entering this Contest, entrants agree to abide by these Official Contest Rules and Regulations and the decisions of the sponsor, The Bank of Nova Scotia (“Scotiabank” or the “Sponsor”), which are final.

    1. CONTEST PERIOD

    The Contest runs from September 1, 2015 at 12:00:00 AM (ET) to August 31, 2016 at 11:59:59 PM (ET) (“Contest Period”).

    2. ELIGIBILITY

    This Contest is open to all legal residents of Canada, subject to the exclusions set out below.

    This Contest is not open to employees, immediate family members of employees (defined as parents, siblings, children and spouses, regardless of where they reside), or persons domiciled with employees of the National Hockey League (“NHL”), its member teams, NHL Enterprises Canada, L.P., NHL Enterprises, L.P., NHL Enterprises B.V. and NHL Interactive CyberEnterprises, LLC (such foregoing NHL entities collectively, the “NHL Entities”), Scotiabank or Bond Brand Loyalty and each of their respective parent, affiliated and related companies, suppliers of the materials and services related to this Contest.

    Sponsor reserves the right to verify the eligibility of each potential prize winner.

    3. HOW TO ENTER

    To enter the Contest, entrants must (1) have a ScotiaHockey NHL® Visa* card that is in “good standing” (as defined below) or (2) hold an eligible bank account (which is any Scotiabank Day-to-Day banking account, as identified in the Scotiabank Day-to-Day Banking Companion Booklet, other than a Scotia US Dollar Daily Interest Account or Scotia Euro Daily Interest Savings Account) that is in “good standing” (as defined below) and a ScotiaHockey NHL® debit card for that account. The ScotiaHockey NHL® debit card cannot be combined with a SCENE ScotiaCard.

    A bank account is not in "good standing" if (i) it has a negative balance exceeding the authorized overdraft limit, (ii) it is closed to service charges, or (iii) it has an unauthorized overdraft written off status. A credit card account is not in "good standing" if (i) it remains delinquent for 60+ days (ii) the current balance is above 120% of the credit limit, or (iii) it is closed.

    ScotiaHockey NHL Visa card: Receive ten (10) contest entries automatically for each qualifying purchase.

    New account bonus: Get a ScotiaHockey NHL® Visa card during the Contest Period and make a qualifying purchase on your card within sixty (60) days of your card being activated (and before the end of the Contest Period) to receive one-hundred (100) Contest entries. New account bonus is not available to customers who had a ScotiaHockey NHL® VISA card prior to the Contest Period. New account bonus is awarded one-time maximum for each VISA account, regardless of the number of joint account holders and supplementary cardholders on such account.

    Only the primary cardholder of a ScotiaHockey NHL® VISA account is eligible to win a prize, however contest entries may be generated by qualifying card purchases made by primary, secondary and supplementary VISA cardholders.

    ScotiaHockey NHL Debit card: Receive one (1) entry automatically for each qualifying purchase.

    New account bonus: Get a ScotiaHockey NHL® debit card and open a new ScotiaHockey NHL® debit card eligible bank account during the Contest Period and make a qualifying purchase with your card within sixty (60) business days of opening the bank account (and before the end of the Contest Period) to receive one-hundred (100) Contest entries. New account bonus is awarded one-time maximum for each joint bank account and only the accountholder making the qualifying purchase is credited with the corresponding entries. New account bonus is not available to any individual more than once nor to any individual who had a Scotiabank bank account prior to the Contest Period.

    NO PURCHASE NECESSARY. No Purchase Method of Entry: To enter the Contest without making a qualifying purchase, you must submit a minimum 100-word original essay on “How hockey has positively impacted my life?” to: Scotiabank Hockey Adventure of a Lifetime”, 6900 Maritz Drive, Mississauga, Ontario, L5W 1L8, Attention: Jennie Varghese during the Contest Period. Be sure to include your full name, mailing address, email address and telephone number with your essay. Entrants will earn one (1) entry for each unique essay submitted. Entries must be handwritten and only one entry per envelope is permitted. Mail entries must bear sufficient postage and be received before the close of the respective Draw Period (as defined below). If an entry is received after the closing date and time of that Draw Period, it will be deemed to be entered into the next Draw Period.

    Qualifying Purchase

    Qualifying purchases are any Point of Sale transaction made from your ScotiaHockey NHL® Visa card or your bank account with your ScotiaHockey NHL® Debit card. Cash advances, Scotia Credit Card Cheques, credit vouchers, returns, payment of annual card fees, interest charges or service/transaction charges are not qualifying purchases.

    4. THE PRIZES

    There will be three (3) grand prizes (each, a “Grand Prize”) available throughout the Contest Period and eighty (80) monthly prizes (each, a “Monthly Prize”) available in each month of the Contest Period. Of the eighty (80) Monthly Prizes, there are five (5) Tier 1 prizes, twenty-five (25) Tier 2 prizes and fifty (50) Tier 3 prizes as described below:

    The Grand Prizes:

    Twelve Grand Prizes will be awarded during the Contest Period.

    1. Four (4) 2016 NHL® All-Star Game packages, each consisting of:
      • Two (2) tickets to the NHL® All-Star Skills CompetitionTM scheduled to be held on January 30th, 2016 at Bridgestone Arena, Nashville, Tennessee
      • Two (2) tickets to the NHL® All-Star Game scheduled to be held on January 31st, 2016 at Bridgestone Arena, Nashville, Tennessee
      • Opportunity to attend behind the scenes experiences such as, for example purposes only, a private arena tour (type, date and location of each experience to be determined and confirmed by NHL Entities, subject to availability)

      The Monthly Prizes:

      There are two (2) types of Monthly Prizes that can be won. Five (5) Tier 1 and forty (40) Tier 2 Monthly Prizes will be awarded for each month of the Contest Period.

      Monthly Draw Periods and Draw Dates:

      The draw for the Monthly Prizes will be held each month during the Contest Period as outlined in the chart below. Eligible entries received during each Monthly Draw Period (as defined in the chart below) will be eligible to win one of that month’s forty-five (45) total available prizes. An entrant can only win one prize per Monthly Draw Period.

      At the end of each Monthly Draw Period, all remaining entries will be ineligible to be drawn for any future Monthly Draw. Potential winners who are selected for a Monthly Prize in a given Monthly Draw Period will not be eligible to be selected for additional Monthly Prizes in that Monthly Draw Period.

      The following conditions apply to all Monthly Prizes:

      5. CONTEST DRAW

      Random draws will be conducted at the offices of Bond Brand Lotalty, an independent agency in charge of the administration of the Contest located at 6900 Maritz Drive, Mississauga, Ontario, L5W 1L8 on each of the Draw Dates from all eligible entries received within the applicable Draw Period.

      A total of five hundred (500) entries will be drawn at random for each Draw Period and allocated to the following pools (“Pools”) based on the order in which they were drawn:

      Grand Prize Pool: Consists of the first 50 entries drawn

      Tier 1 Prize Pool: Consists of the fifty-first (51st) to the two hundredth (200th) entry drawn

      Tier 2 Prize Pool: Consists of the two hundred and first (201st) to the five hundredth (500th) entry drawn.

      No entries will be carried over to any subsequent Draw Periods. The odds of winning depend on the number of eligible entries received during each Draw Period.

      A representative of the Sponsor will attempt to notify the potential winner by telephone the first Saturday following each Draw Date during the hours of 12:00PM and 5:00PM Eastern Time. If a potential winner cannot be reached by telephone, the potential winner will be ineligible to claim the Prize. The next entrant, in the order that they were drawn from the respective Pool, will be selected and the same eligibility rules will apply to that potential winner. If the maximum number of potential winners of a Grand Prize and/or Monthly Prizes in a given Draw Period are not reached on the first Saturday after the Draw Date between 12:00PM and 5:00PM, a representative of the Sponsor will continue calling potential winners from the appropriate Pool(s) the following week, Monday to Friday between 5:00PM and 8:00PM Eastern Time until the maximum number of potential winners are reached.

      The order that prizes will be distributed for each Draw Period is as follows:

      Grand Prize: The first (1st) person in the Grand Prize Pool reached by telephone and who meets the eligibility criteria is a potential winner of the applicable Grand Prize.

      Monthly Prize:

      All Potential Winners

      If applicable, the potential winner’s ScotiaHockey VISA account or Scotiabank bank account, whichever product gave rise to the entrant being selected, must be in good standing at the time of selection in order for the entrant to be eligible for a prize.

      Adult Potential Winners

      Each potential winner must first correctly answer, unaided, a time-limited, mathematical skill-testing question. When the potential winner is reached by phone by a representative of the Sponsor, they will be asked to answer this question. If the winner has answered the phone but indicates that he/she is not in a position to be given the skill testing question at that time (for example, the winner is driving, handling children, etc.), the agent will offer to call the person back within an agreed upon number of minutes up to one (1) hour from the point of the call (call backs will occur in the same day up until 5:00PM ET on Saturday and 8:00PM ET from Monday to Friday). If the potential winner provides an incorrect answer to the skill-testing question, that potential winner will be disqualified and the agent will re-visit the list of eligible entries and start the process of calling out to the next potential winner on that list.

      Potential winners must sign and submit to the Sponsor a declaration of eligibility and release that will include, without limitation, a declaration that the potential winner is eligible to win the applicable prize and authorization for the Sponsor and their agents to announce and publish the potential winner name, address (city and province only) and/or photograph or image or other likeness, without further compensation, at any time and from time to time, in any future publicity.

      Persons accompanying each Grand Prize and Tier 1 Monthly Prize winner (a “guest”) must also sign eligibility and release form. In the event that the potential winner’s guest is a minor, the winner must be the parent or legal guardian of that minor guest and must sign a declaration of eligibility and release on behalf of the minor guest. In such cases, the winner will at all times be responsible for the conduct of the minor guest.

      Such declaration and release will be sent to Bond Brand Loyalty at 6900 Maritz Drive, Mississauga, Ontario, L5W 1L8 or by fax at 1-888-352-6058

      Minor Potential Winners

      Each potential winner must have his/her parent or legal guardian correctly answer, unaided, a time-limited, mathematical skill-testing question.       Each potential winner under the age of majority in his or her province or territory of residence will be asked to obtain a signed declaration of eligibility and release from his/her parent or legal guardian and the parent or legal guardian must provide their contact information and indicate their consent. If a potential winner under the age of majority in his or her province or territory of residence is selected for one of the Grand Prizes or a Tier 1 Monthly Prize, a parent or legal guardian must accompany the minor on the awarded experience including all travel and activities throughout the duration of the trip. The accompanying parent or legal guardian will at all times be responsible for the conduct of the minor winner.

      Each potential winner must also obtain permission from his/her parent or legal guardian for the use, collection and disclosure of his/her name, likeness (where applicable), and age, for displaying their likeness for, for purposes of administering this Contest, future promotions that refer to this Contest, and for other purposes described herein.

      The parent or legal guardian of each potential winner must sign and submit to the Sponsor a declaration of eligibility and release that will include, without limitation, a declaration that the potential winner is eligible to win the Prize and authorization for the Sponsor and their agents to announce and publish the potential winner’s name, address (city and province only) and/or photograph or image or other likeness, without further compensation, at any time and from time to time, in any future publicity. Such declaration and release will be sent to Bond Brand Loyalty at 6900 Maritz Drive, Mississauga, Ontario, L5W 1L8 or by fax at 1-888-352-6058.

      Scotiabank, acting reasonably, will attempt to contact the parent or legal guardian of each potential winner under the age of majority by telephone within five (5) business days of the applicable draw. In the event the parent or legal guardian of a potential winner cannot be contacted within five (5) business days of the initial phone call he or she, as well as the applicable entrant, will be disqualified and the next potential winner, or the parent or legal guardian of the next potential winner will be notified.

       

      6. PRIVACY

      The Sponsor is committed to respecting your privacy rights. Any personal information gathered will be handled in strict accordance with the Scotiabank Group Privacy Agreement found at www.scotiabank.com and all applicable privacy legislation. The Sponsor will not sell your personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Sponsor as disclosed herein. Please note that by agreeing to receive a prize, winners consent to the Sponsor’s use of your personal information in order to manage and administer this Contest.

      7. GENERAL RULES

      The Sponsor shall not be liable for lost, late, incomplete, misdirected, not received, stolen, mutilated, or garbled entries. By entering this Contest, entrants accept and agree to be bound by these Official Rules and Regulations and the decisions of the Sponsor and the independent agency, which are final, binding and conclusive on all matters relating to this Contest. All entries become the property of the Sponsor and will not be acknowledged or returned and no correspondence will be entered into except with the selected entrant who will be notified by telephone or email. The Sponsor reserves the right to disqualify all entrants who fail to follow these Official Rules or who make any misrepresentation relating to the Contest, drawing and redemption of any prize. This Contest is subject to all applicable federal, provincial and municipal legislation. By agreeing to receive a prize, winners consent to the use of the winner’s name, photograph and/or voice recording for publicity purposes without additional compensation or permission, except where prohibited by law.

      The Sponsor and the NHL Entities shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, any prize awarded in this Contest or the events forming part of this Contest. The Sponsor and the NHL Entities, and each of their officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, sponsor, successors and assigns (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty, and (iii) are not liable for injury, loss, or damage of any kind resulting from the acceptance, use or misuse of any prize, travel related thereto or otherwise from participation in this Contest.

      The Sponsor reserves the right to withdraw, terminate or revise this Contest at any time without prior notice, subject to the approval of the Régie des alcohols, des courses et des jeux with respect to the province of Quebec.

      For Residents of Quebec, any litigation concerning the conduct or administration of this publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation concerning the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

      This Contest is subject to all applicable federal, provincial and municipal laws and is void where prohibited.
