What this Terms of Access Agreement Covers
This Agreement between you and Scotiabank Turks and Caicos Limited, ("Scotiabank", "the Bank"), governs the use of Scotiabank Internet Banking, an electronic service that permits Scotiabank customers to access account information and financial services through the use of personal computers or similar access devices. In this Agreement, the words "you" and "your" refer to the account holder(s) and its authorized signatories. This Agreement and your use of Scotiabank Internet Banking are subject to the Bank's ScotiaCard Cardholder Agreement, as amended from time to time and if you are a business customer, to the Bank's Cash Management Services Service Agreement, as amended from time to time. Account Access
Account(s) to be accessed through Scotiabank Internet Banking will include all accounts listed on your Scotiabank Customer Profile. In order to link different accounts, you must be a signatory of these accounts.
Lost/ Stolen Card or Password
You agree to keep your password safe and not to share the same with anyone and to notify us immediately if you suspect that your password has been compromised or that your account(s) has been or may be accessed by an unauthorized party(ies), you must phone Customer Service at (649) 941-7774 or toll-free from the U.S. 1 (800) 472-4648 immediately and then write to us at your branch or to Scotiabank (Turks and Caicos) Ltd, Cherokee Road, P.O. Box 15, Providenciales, Turks and Caicos Islands, BWI
Security Procedures
You acknowledge by clicking “I Accept” to this Terms of Access Agreement that you have read the Safe Computing Practices for protecting access to your accounts and information on your personal computer, and agree that those procedures are commercially reasonable.
What Scotiabank Internet Banking Will Cost
Scotiabank Internet Banking access is available to you at fees determined from time to time by the Bank, which you agree to pay by your access of the service. You hereby acknowledge having reviewed the Internet Banking Pricing Schedule posted on the website. If you are a business customer, you hereby acknowledge having reviewed the CMS Service Request & Pricing Schedule, which you have discussed with your Account Manager. We will notify you of any changes in the Internet Banking Pricing Schedule and such notification may be made through the website. You hereby agree and acknowledge that any fees for use of the Scotiabank Internet Banking service will be debited from your account on a monthly basis. All other services offered by the Bank remain at their current pricing. All charges incurred in connecting to Scotiabank Internet Banking are your responsibility.
Changes in Services / Terms / Fees
The Bank may change the Scotiabank Internet Banking services and the terms, including fees, set forth in this Agreement at any time. You will be notified of any such change as required by applicable law. You understand that by using Scotiabank Internet Banking after a change to the Terms of Access becomes effective, you will be presented with the revised Terms of Access Agreement at the time of login and will be required to click “I Accept” to acknowledge that you accept these revised Terms of Access. If you do not agree to the revised Terms of Access, you will click “I Decline” and you will not be able to login to Scotiabank Internet Banking.
Suspension/Cancellation of Scotiabank Internet Banking
You may cancel this Agreement at any time by written notification to the Bank. The Bank shall have the right in its sole discretion to (i) limit your use of Scotiabank Internet Banking; (ii) suspend your use of Internet Banking, or (iii) terminate your use of Scotiabank Internet Banking and cancel this Agreement, for any reason, at any time.
Confidentiality at Scotiabank
You have a right to confidentiality and financial privacy provided always that the Bank may disclose any information about you and your accounts:
- to Scotiabank Bahamas in order to support all your internet banking services.
- in response to credit inquiries;
- pursuant to legal process or subpoena, or as currently drafted, or in accordance with the Confidential Relations Ordinance 1996 and the Banking Ordinance 1979.
Limit of Liability
The Bank agrees to make reasonable efforts to ensure full performance of Scotiabank Internet Banking. The Bank will be responsible for acting only on those instructions sent through Scotiabank Internet Banking, which are actually received. The Bank does not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of messages you send. The Bank is not responsible for any losses or delays in transmission of instructions arising out of the use of any Access Service Provider or caused by any browser software. The Bank is not responsible should you give incorrect instructions or if your payment instructions are not given sufficiently in advance to allow for timely payment. Refer to Section 8, Limitation of Liability, ScotiaCard Cardholder Agreement and if you are a business customer, Section 9 of the Cash Management Services Service Agreement.
Any information you receive from the Bank is believed to be reliable. However, it can only be provided on a best-effort basis for your convenience and is not guaranteed. The Bank is not liable for any deficiencies in the accuracy, completeness, availability or timeliness of such information or for any investment or other decision made using this information.
The Bank is not responsible for system disruptions including disruptions caused by any computer virus or related problems.
NEITHER THE BANK, NOR ANY OTHER INFORMATION PROVIDER MAKES ANY EXPRESS OR IMPLIED WARRANTIES CONCERNING INTERNET BANKING SOFTWARE OR SERVICES OR BROWSERS INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTY PROPRIETARY RIGHTS UNLESS DISCLAIMING SUCH WARRANTIES IS PROHIBITED BY LAW.
Prohibitions on Use
You will not: (i) access or use the Services for an illegal, fraudulent or defamatory purpose, or (ii) take steps or actions that could or do undermine the security, integrity, effectiveness, goodwill or connectivity of the Services (including but not limited to fraudulent, malicious or other activities that threaten to harm or cause harm to any other person). You expressly authorize and instruct the bank to suspend your use of Scotiabank Internet Banking and without prior notice, when it has been deemed that the use of Scotiabank Internet Banking may infringe any of the aforementioned prohibitions on use.
Authorized Users
For business customers, Internet banking access to account information and financial services will be made available to those persons who are authorized to access the account by means of their own personal and individual login and password identification. You agree to assume full responsibility for any and all actions taken by an authorized user. You agree and acknowledge that your personal login information and password is not to be shared, divulged, or disclosed to anyone and that the authorized users will only access your account information and financial services by means of login identification and password assigned to that particular authorized user.

Electronic Messages
Because normal internet e-mail transmissions may not be secure, you agree to contact us regarding your account electronically only through the Scotiabank Internet Banking Secure Messaging function or by phone and not through other e-mail methods. You also agree to receive communications regarding your account electronically and will not attempt to circumvent receiving any messages. You are deemed to have received any electronic messages sent to you when they are made available to you.
Security
Access to Scotiabank Internet Banking is by means of a ScotiaCard Number and password unique to you. You must transmit your password correctly to use Scotiabank Internet Banking. You agree that we are authorized to process any instructions we receive under your password, and that these procedures are commercially reasonable.
Account Transfers and Bill Payments
When you instruct the Bank to transfer funds between your Scotiabank accounts or pay a bill through Scotiabank Internet Banking, you authorize the Bank to withdraw the necessary funds from the Scotiabank account you designated. You agree that you will instruct the Bank to make a withdrawal only when a sufficient balance is or will be available in your designated account at the time of withdrawal. The Bank will not be obligated to act on any withdrawal instruction from you if sufficient funds, including overdraft lines of credit, are not available in the account you designated.
If you are a personal banking customer, you may make cumulative account transfers of up to USD 120,000 and bill payments of up to USD 30,000 per day on Scotiabank Internet Banking. If you are a business banking customer please refer to the daily limits that have been set by your Account Manager. Account transfers between deposit accounts will be posted immediately to both accounts. Account transfers to credit accounts will be debited to your account immediately and if made before 12:00 midnight local time Monday through Friday will normally be posted to your credit account as of the date of the transaction unless that day is a holiday. If account transfers to credit accounts are conducted on Saturdays, Sundays or holidays, they will normally be posted to the credit account as of the next business day. Bill payments will be debited immediately from your account but the time of credit of the payee's account will depend on the payee's processing policies. The Bank is not responsible for processing delays by the payee. Refer to section 7, Posting of Transactions in the ScotiaCard Cardholder Agreement.
Indemnification
You agree to indemnify and hold harmless the Bank, its associates, subsidiaries and affiliates and their officers, directors, employees and agents, all third party suppliers and their respective officers, directors, employees and agents, from and against any and all liabilities, damages, awards, settlements, losses, claims and expenses, including reasonable attorney's fees and expenses and costs of investigation (collectively, "Damages") resulting from third party claims to the extent such claims, if brought by you directly against Scotiabank, would be excluded pursuant to the ScotiaCard Cardholder Agreement or the Cash Management Services Service Agreement.
Severability
In the event any one or more of the provisions of this Agreement shall for any reason be held to be invalid, illegal or unenforceable, the remaining provisions shall remain valid and enforceable.
Precedence
If there is a conflict between any provisions of your ScotiaCard Cardholder Agreement and this Agreement your ScotiaCard Cardholder Agreement prevails, except for the provisions of this Agreement regarding Account Transfers and Bill Payment. If you are a business customer and there is a conflict between any provisions of your Cash Management Services Service Agreement and this Agreement your Cash Management Services Service Agreement prevails.
Notices

Governing Law
This Agreement shall be governed by the laws of the Turks and Caicos Islands, BWI
