CONTEST PERIOD
This contest commences at 9:00 a.m. (ET) Monday June 1, 2009, and ends at 7:00 p.m. (ET) Monday August 31, 2009 (the “Contest Period”).
HOW TO ENTER
You will be automatically† entered when you make a single purchase during the Contest Period of the CAD equivalent of $1,000 or more in American Express®? Travellers Cheques in Canada (“Travellers Cheques”) at any Scotiabank branch or by calling 1-888-431-3890 or through Scotia OnLine® Financial Services. Limit one entry per Travellers Cheque purchase.
NO PURCHASE NECESSARY: To enter without purchase send a 50-word (or more) hand written essay about “The Advantages of American Express Travellers Cheques” with full name, address, age and telephone number to: Amex Scotiabank Sweepstakes, PO Box 4099, Paris, ON N3L 3W9. All no-purchase entries must be postmarked by Monday August 31, 2009 (the “Contest Closing Date”) and must be received by no later than Monday September 7, 2009. You can enter as often as you wish by mail but each mail-in entry must be a unique essay bearing sufficient postage and mailed in a separate envelope.
All entries become the property of The Bank of Nova Scotia (“Contest Sponsor”) who assumes no responsibility for late, lost, delayed, damaged, destroyed, misidentified or misdirected entries. By entering this contest, entrants agree to abide by these contest rules and regulations and the decisions of the independent contest organization (“ICO”). All decisions of the ICO regarding this contest are final and binding without right of appeal, including without limitation, decisions regarding the eligibility/disqualification of entries.
WHO CAN ENTER
This contest is open to individuals who are legal residents of Canada and who have reached the age of majority in their province or territory of residence on or before Monday August 31, 2009, however, employees (and those with whom such employees are domiciled) of the ICO, Contest Sponsor, Amex Canada Inc., Amex Bank of Canada, and any of their respective subsidiaries, affiliates, advertising and promotional agencies are not eligible to enter.
THE PRIZES
There will be six (6) prizes available to be won, each consisting of $5,000 cash, which will be deposited into a Scotia Money Master® High Interest Savings Account. If you do not currently have a Money Master® High Interest Savings Account, then you will be required to open one (at no cost) in order to claim your prize. The prize must be accepted as awarded and is not transferable or convertible to cash. No substitutions except at Contest Sponsor’s option. Contest Sponsor reserves the right to substitute a prize with one of equal or greater value. The same individual cannot win more than once.
CONTEST DRAW
On or about September 30, 2009 (“Draw Date”) at 2:00 p.m. in Brantford Ontario, a random draw will be made from among all eligible entries received during the Contest Period. The odds of being selected depend on the total number of eligible entries received. If the ICO, acting reasonably, cannot contact by phone a selected entrant within two weeks of the Draw Date, then that selected entrant will be disqualified and an alternate entrant will be selected from among the remaining eligible entries. This process will be repeated until the prize has been awarded or there are no remaining eligible entrants.
HOW TO WIN
If a purchase entry is selected and the associated purchase amount is equal to or greater than the CAD equivalent of $1,000, that entry will be eligible to win. All purchase entries that do not meet the minimum purchase amount, will be disqualified if selected. In order to win, the selected entrant must first correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by the ICO. The winners will be contacted by the Contest Sponsor to make arrangements for the awarding of the prize. Before receiving the prize, each winner must sign the Contest Sponsor’s standard declaration and release forms, which, among other things, release the Contest Sponsor, the ICO, Amex Canada Inc. Amex Bank of Canada, and any of their respective subsidiaries, affiliates, advertising and promotional agencies, and each of their respective officers, directors, employees and affiliates (collectively the “Releasees”), from any and all liability in connection with this contest, the selected entrant’s participation therein and/or the awarding and use/misuse of a prize or any portion thereof.
GENERAL INFORMATION
By participating, entrants agree to release, discharge and hold harmless the Releasees from any and all injuries, liability, losses and damages of any kind resulting from their participation in the contest or their acceptance, use or misuse of a prize. Releasees are not responsible for and shall not be liable for: (a) any electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; (b) failed, incomplete, garbled or delayed computer transmissions; (c) lost, late, or misdirected entries due to errors or delays in mail, courier or other delivery services or due to other technical problems described in (a) above; (d) incomplete or incorrect entries; or (e) any condition caused by events beyond the control of the Releasees that may cause the contest to be disrupted or corrupted. By participating, each selected entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Contest Sponsor in any manner whatsoever, including print, broadcast or the internet.
Contest Sponsor reserves the right in its sole discretion, subject to the approval of Régie des alcools, des courses et des jeux (“Régie”) in Quebec, to cancel or suspend the contest or any portion thereof should virus, bugs or other causes beyond the control of Contest Sponsor corrupt the administration, security or proper function of this contest. Entry information becomes the property of the Contest Sponsor and any personal information collected will be used solely for the purposes of administering this contest in accordance with its privacy policy.
The Contest Sponsor reserves the right, subject to approval from the Régie, to terminate, modify or suspend the contest or these rules if events beyond their reasonable control make continuation unfeasible and has corrupted the proper and fair administration of the Contest. All entries become the property of the Contest Sponsor and none will be returned. The Contest Sponsor is not acting as agent of Amex Canada Inc. or the prize supplier. This contest is subject to all applicable federal, provincial and municipal laws.
For Quebec Only: Any litigation respecting the conduct or organization of this contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
