CONTEST RULES AND REGULATIONS


Open to residents of Canada

NO PURCHASE IS NECESSARY. By entering this Contest (defined below), entrants agree to abide by these contest rules and regulations (the “Official Rules”). The decisions of the Sponsor (as defined below) with respect to all aspects of the Contest are final. The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter. You understand that you are providing your information to the Sponsor and not to Facebook or Twitter. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy and will only be used by the Sponsor in connection with publicity relating to the Contest. Facebook and Twitter are completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook or Twitter.

  1. SPONSOR & CONTEST PERIOD: The Scotiabank Brand Ease Contest (the “Contest”) is sponsored by The Bank of Nova Scotia (the "Sponsor"). The Contest commences at 10:00:00 AM on March 20, 2017 and will end at 9:59:59 AM on May 15, 2017 (the "Contest Period"). All times referred to in these Official Rules are Eastern Times.
  2. ELIGIBILITY: To enter the Contest and be eligible to win a Prize (see rule 7), a person (“Entrant”) must, at the time of entry, be a resident of Canada who has reached the age of majority in his/her province/territory of residence. Specifically excluded from entering the Contest are: (i) employees, officers, directors, agents and representatives of the Sponsor, its advertising and promotional agencies and each of their respective subsidiaries and affiliates; and (ii) a member of any such person’s immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the person or not). In these Official Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner or spouse.
  3. HOW TO ENTER: No Purchase is Necessary.
    1. FACEBOOK: During each Weekly Prize Period (as defined in rule 5), visit the Scotiabank Facebook page at https://www.facebook.com/scotiabank/?fref=ts (the “Contest Website”). The Sponsor will post a topic (the “Contest Post”) on the Contest Website on each Weekly Prize Period’s start date and time. Click on the “Comment” icon below the Contest Post to share your story relating to the Contest Post for the applicable Weekly Prize Period (“Story”). Upon doing so, click “post” and your Story will be posted to the Contest Website and will be considered an official entry (the (“Entry”) into the Contest. A person may enter once during each Weekly Prize Period but the Story associated with each Entry must be unique. Entrants are subject to Facebook Terms of Service and Rules; these can be found at https://www.facebook.com/legal/terms. Sponsor is not responsible in any way for any decisions Facebook makes regarding the Entrant's account with Facebook.
    2. TWITTER: During each Weekly Prize Period (as defined in rule 5), the Sponsor will post a topic (the “Contest Post”) on the Sponsors’ Twitter account @Scotiabank on each Weekly Prize Period’s start date and time. Respond with a story to the topic with the hashtag #startmeup (the “Twitter Hashtag”) and mention “@Scotiabank” (a “Twitter Mention”) on Twitter from your Twitter account to submit a Twitter entry (the “Twitter Entry”) (subject to compliance with these Official Rules). A person may only tweet a story once per Weekly Prize Period and re-tweets will not be accepted. Entrants are subject to Twitter's Terms of Service and Rules; these can be found at https://twitter.com/tos. Sponsor is not responsible in any way for any decisions Twitter makes regarding the entrant's account with Twitter.
      To enter the Contest from your Twitter account, you must have a Twitter account and follow the Sponsor’s official Twitter account (@Scotiabank). To become a Follower of the Sponsor, you must access your Twitter account and search people for “Scotiabank” and click the “Follow” button corresponding to @Scotiabank. Multiple, separate tweets contributed to the Twitter Hashtag and/or any re-tweets of an entrant’s tweet will not increase the chances of winning. Anyone found to use multiple accounts to enter the Contest will be ineligible. Anyone found “spamming” by posting multiple unrelated updates or comments that are unrelated to the Contest discussion or by sending large numbers of duplicates to @Scotiabank will be disqualified.
  4. ENTRIES: Please note, all posts submitted as an Entry through Facebook or Twitter must be set to public. Limit of one (1) Entry per Weekly Prize Period per Facebook account and/or Twitter account per person. You may only use one (1) Facebook account and/or one (1) Twitter account to enter the Contest. Any person who is found to have entered in a fashion not sanctioned by these Official Rules and/or who has submitted more than the number of Entries permitted by these Official Rules will be disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete Entries, which will be void. All Entries become the property of the Sponsor upon receipt and none will be returned. Proof of posting an Entry is not proof of receipt by Sponsor. Entries must be received during an applicable Weekly Prize Period in order to be entered into the applicable Weekly Prize Period judging process. In the event an Entrant posts content deemed inappropriate in the sole and absolute discretion of the Sponsor, he or she will be disqualified. The Sponsor reserves the right to remove from the Contest Website any Entries that do not satisfy the requirements set out in rule 6, as determined in its sole and absolute discretion. Such Entries will be ineligible for entry into the Contest. By entering the Contest and submitting an Entry, each Entrant: (i) without limiting Facebook’s Terms of Service, grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry in favour of the Sponsor; and (iii) agrees to release and hold harmless the Releasees (as defined in rule 12) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the Entry.
  5. WEEKLY PRIZE PERIODS: The Contest Period will be divided into eight (8) Periods (each a “Weekly Prize Period”) which are as follows:

  6. FORMAT AND CONTENT: Each Entry must:
    1. be in English or French;
    2. be no more than 150 words in length (Facebook Entry);
    3. be no more than 140 characters in length (Twitter Entry);
    4. be sent by clicking the “Comment” icon on the Contest Post posted to the Contest Website (Facebook Entry);
    5. relate to the Contest Post;
    6. not be retweeted (Twitter Entry);
    7. not be based on another person’s comment;
    8. not post the same content more than once;
    9. comply with Facebook and Twitters Terms of Service and Rules;
    10. be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for all persons, including persons under the age of 13;
    11. not contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate content of any kind whatsoever;
    12. not contain any content that promotes any product or service other than that of the Sponsor;
    13. not contain any language suggesting or encouraging illegal activity;
    14. not contain anything that infringes or that may infringe anyone’s rights, including intellectual property rights;
    15. not contain any personal information;
    16. not contain any identifiable third party products and/or trade-marks, brands, logos or copyright, other than those of the Sponsor;
    17. not contain any copyrighted works (other than as owned by the eligible Entrant) or third party content that may be subject to and protected by intellectual property laws, including but not limited to music, artwork, video and photographs;
    18. contain entirely original materials that have never before been distributed, shown publicly or published, or selected as a winner in any other contest;
    19. not contain any reference to or likeness of identifiable third parties, unless consent has been obtained from all such individuals and such individuals are of the age of majority.
  7. PRIZES: There is a total of nine (9) prizes available to be won consisting of the following:
    1. WEEKLY PRIZES: There will be a total of eight (8) weekly prizes (each referred to as a “Weekly Prize”) available to be won with one (1) Weekly Prize per Weekly Prize Period. Each of the below Weekly Prizes will be awarded to the winner based on the winner’s Story (at the sole and absolute discretion of the Sponsor) that was selected in the Weekly Judging Process. The Sponsor will select one (1) of the Weekly Prizes that they, at their sole and absolute discretion, find relatable to the Winner’s Story. There will only be one (1) of each of the Weekly Prizes available to be won and they are as follows:

      Limit of one (1) Weekly Prize per person during the Contest Period. The total ARV of all Weekly Prizes is $9,339.89 (CDN).
    2. GRAND PRIZE: There will be one (1) grand prize (the “Grand Prize”) available to be won, which consists of one (1) Samsung 65” UHD Curved Smart TV with an ARV of $2,899.99 (CDN), one (1) Samsung Curved Soundbar with an ARV of $949.99 (CDN), and One (1) Samsung Curved Blu-Ray Player with an ARV of $349.99. The total ARV of the Grand Prize is $4,199.97 (CDN).
    Prizes must be accepted as awarded without substitution, are not transferable, not convertible to cash and not for resale. The Sponsor reserves the right, in the event that a Prize cannot be awarded as described for any reason, to substitute another prize of equal or greater value, without liability.
  8. WEEKLY JUDGING PROCESS: A panel of judges appointed by the Sponsor will judge all eligible Entries received during each Weekly Prize Period on the basis of: (i) individuality; (ii) creativity; and (iii) quality (collectively, the "Criteria"). All Criteria will be weighed equally. Each Entry will be given a score (the “Score”) by the judges. The Entrant associated with the Entry that received the highest Score will be deemed to be the selected Entrant for the applicable Weekly Prize Period (the “Selected Entrant”). Odds of being selected as a Selected Entrant depend on the caliber and number of Entries received during the relevant Weekly Prize Period. In the event of a tie between two or more Entries based on the total Score, the Sponsor will assign a new judging panel to judge the tied Entries and the Entrant with the Entry with the new highest Score based on the Criteria will be deemed to be the Selected Entrant. Judging will take place in Toronto, ON at 2:00:00 PM on each weekly judging process end date associated with each Weekly Prize Period as defined in rule 5 (the “Judging Process End Date”). Once the Selected Entrant has been deemed the confirmed winner of the Weekly Prize Period (see rule 10), his/her Entry will be entered into the Grand Prize Draw. Please note: Non-winning Entries will not be carried over into the following Weekly Prize Periods.
  9. GRAND PRIZE DRAW: One (1) Grand Prize Draw will take place at an agent of the Sponsor in Toronto, ON at 2:00:00 PM ET on May 25, 2017 (the “Grand Prize Draw Date”) from among all eligible Entries received during the Contest Period. The agent of the Sponsor will attempt to contact the Selected Entrant by sending a direct private message to the Selected Entrant’s Twitter or Facebook account (depending on the method of entry) (collectively referred to as a “Private Message”) associated with the potential winning Entry within two (2) business day of the Draw Date. The Selected Entrant associated with the selected Facebook account or Twitter account will then be asked to reply via Private Message to provide his/her contact information including full name, email address, and telephone number (the “Contact Information”) within two (2) business days so that a declaration and release form (the “Release Form”) can be issued and so that a skill testing question can be administered (see below). If a Selected Entrant (a) does not reply via Private Message with his/her contact information within two (2) business days; (b) fails to correctly answer the skill testing question (see rule 11); or (c) fails to return the properly executed Release Form within the specified time (see rule 11), then he/she will forfeit his/her opportunity to be the Selected Entrant and another Entrant will be randomly selected and so on until there are no more eligible entries.
  10. WEEKLY PRIZE WINNER NOTIFICATION: The Sponsor will attempt to contact each Selected Entrant by sending a Private Message to the Selected Entrant’s Facebook or Twitter account (depending on the method of entry) associated with the potential winning Entry within two (2) business days of the applicable Judging Process End Date. The Selected Entrant associated with the selected Facebook or Twitter account will then be asked to reply via Private Message to provide his/her contact information including full name, address, email address, and telephone number within three (3) business days so that a Release Form can be sent to them. If a Selected Entrant (a) does not reply via Private Message with his/her contact information within three (3) business days; ; (b) fails to correctly answer the skill-testing question (see rule 11); or (c) fails to return the properly executed Release Form within the specified time (see rule 11), then he/she will forfeit his/her opportunity to be the Selected Entrant and (i) the Entrant with the next highest Score will be selected for the applicable Weekly Prize and so on until there are no more eligible Entries in the applicable Weekly Prize Period or (ii) The Entrant with the next highest Score will be selected for the Grand Prize draw and so on until there are no more Weekly Prize winners.
  11. WINNER DECLARATION: To be declared a prize winner, each selected entrant must answer correctly, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill testing question. Each Selected Entrant will also be required to sign and return within five (5) business days of notification the Release Form, which (among other things): (a) confirms compliance with these Official Rules including eligibility requirements; (b) acknowledges acceptance of the Prize as awarded; (c) releases the Sponsor, its advertising and promotional agencies and each of their respective subsidiaries and affiliates and each of their respective shareholders, officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the Selected Entrant’s participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; and (d) agrees to the publication, reproduction and/or other use of the his/her name, address, voice, Story, statements about the Contest, photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast and the internet.
  12. PRIZE DELIVERY: Each Prize will be shipped to the applicable winner within thirty (30) days of receipt and verification of his/her Release Form to the address shown on the Release Form (and subject to compliance with all other condition and requirements provided in these Official Rules).
  13. CONDITIONS OF ENTRY: By entering the Contest, Entrants (i) confirm compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by these Official Rules and by the decisions of the Sponsor, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification.
  14. GENERAL: The Releasees do not assume any responsibility for (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with these Official Rules; (ii) any loss, damage, or claims caused by, or arising directly or indirectly from, an awarded Prize or the Contest itself; or (iii) any failure of the Contest Website during the Contest Period, including any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or Entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an Entrant’s or any other person's computer related to or resulting from downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest. Entry material/data that has been tampered with or altered is void.
  15. APPLICABLE LAWS: All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of Entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with (i) the laws of the Province of Québec and the laws of Canada applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
  16. CONTEST TERMINATION, SUSPENSION AND AMENDMENT: The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, where required, to terminate or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned (for example as a result of tampering or infection by computer virus), the Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, where required, to terminate the Contest.
  17. FOR QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  18. DISCREPANCY OR INCONSISTENCY: In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to point of sale, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.
  19. CONSENT TO USE PERSONAL INFORMATION: The Sponsor is committed to respecting Entrants’ privacy. Any personal information collected for this Contest shall be used by the Sponsor solely for the purpose of managing and administering this Contest. Any personal information collected will be handled in strict accordance with the Scotiabank Privacy Agreement found at www.scotiabank.com and all applicable privacy legislation. The Sponsor will not sell an Entrant’s personal information collected for this Contest to any third parties.
